Last December, the OCR released new guidance on how HIPAA allows covered entities and their business associates to use health information exchanges in order to disclose protected health information (PHI).

Specifically, the new guidance provides examples of how HIPAA permits these organizations to disclose PHI during the COVID pandemic in an effort to improve the public's health during the pandemic.
